01Acceptance of these terms

By accessing our website, using our services, or sending or receiving messages through ari, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the services.

02The services

Inconel is an applied-AI studio. ari is our always-on front-desk product that answers calls and messages, qualifies inquiries, books estimates and appointments, and follows up on quotes on behalf of the businesses that use it.

The businesses that use ari are independent operators; Inconel provides the software and messaging that power their front desk. We may change, suspend, or discontinue any part of the services at any time.

03SMS / text-messaging program

By providing your mobile number to a business that uses ari (or to Inconel) and engaging with us, you consent to receive recurring SMS text messages as described below. Consent is not a condition of any purchase.

What you will receive

ari sends service-related text messages, including replies to your questions, appointment and estimate confirmations and reminders, follow-ups on open quotes, and related front-desk communications. Message frequency varies based on your interaction, and message and data rates may apply.

Managing your messages

Carriers and delivery

Supported carriers include major U.S. carriers (including AT&T, Verizon, and T-Mobile). Carriers are not liable for delayed or undelivered messages, and message delivery depends on factors outside our control.

Privacy

See our Privacy Policy for how we handle messaging data. We do not sell your information, and we do not share your mobile opt-in or consent data with third parties for marketing.

04Eligibility

You must be the authorized user or account holder of the mobile number you use with the service, and old enough to form a binding contract in your jurisdiction.

05Acceptable use

You agree not to misuse the services, including by:

• Sending unlawful, abusive, harassing, or fraudulent content.
• Attempting to disrupt, overload, or gain unauthorized access to the services.
• Using the services to violate others' rights or any applicable law or regulation.

06Intellectual property

The Inconel and ari names, software, and content are owned by Inconel or its licensors and are protected by law. We grant you a limited, revocable, non-exclusive right to use the services as intended; all other rights are reserved.

07Third-party services

The services rely on third parties, including telephony and messaging carriers and cloud providers. We are not responsible for their acts or omissions, and message delivery depends on factors outside our control.

08Disclaimers

The services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the services will be uninterrupted, error-free, or that every message will be delivered.

09Limitation of liability

To the maximum extent permitted by law, Inconel will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from delayed or undelivered messages or from your use of the services.

10Indemnification

You agree to indemnify and hold Inconel harmless from any claims, damages, or expenses arising out of your misuse of the services or your violation of these Terms.

11Changes to these terms

We may modify these Terms at any time. Material changes take effect when posted and are indicated by the “Last updated” date above. Your continued use of the services means you accept the updated Terms.

12Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules.
